1. Provider and scope
These Terms of Use apply to your use of the services offered by NorthTrack General Aviation, owner Enes Yakup Krughöfer, in particular the Main App, Procedure Trainer and associated online functions.
2. Purpose
NorthTrack is a learning, training, planning and support platform for general aviation. Content and functions can support your education and preparation, but they do not replace required flight training, instruction by authorised persons or the applicable official documents.
3. Not a sole operational source
Weather, radar, map, aerodrome, navigation, airspace and other aviation-related information may be time-dependent, cached, incomplete or regionally different. For operational decisions you must always consider the applicable current official sources, procedures, NOTAM/AIP and aircraft documentation.
4. Aircraft/POH/AFM data
Generic training values, calculation aids and checklists do not replace aircraft-specific POH, AFM, operator, club or training-organisation documents. You must use the data applicable to your specific aircraft.
5. Procedure Trainer
The Procedure Trainer is a training product, not an approved FSTD/FNPT, and does not generate creditable flight-training time. Simulated scenarios, traffic situations, ATC/instructor logic and assessments may be generated deterministically. You must not treat fictional training aerodromes or frequencies as real operational information.
6. Training ATIS
Training ATIS and other synthetic practice scenarios are solely for training and are not live ATIS or real operational information.
7. Account
Certain functions may require a NorthTrack account and email verification. You are responsible for the security of your credentials and must not misuse your account.
8. Guest, Free, Premium and Trial functions
The functions available to you as a Guest, Free, Trainer Premium, NorthTrack Premium or Trial user depend on the product model actually activated. Subscription or Trial functions that are not active are not advertised to you as available.
9. Purchases and subscriptions
Where in-app purchases or subscriptions are activated, the product, price, term, cancellation and billing information displayed in the relevant store also applies. Management and cancellation of a subscription concluded through Apple StoreKit takes place exclusively through your Apple ID account settings; NorthTrack cannot receive or process such cancellations itself. Deleting your NorthTrack account does not automatically end an active Apple subscription. If you are 16 or 17 years old, concluding a paid subscription requires the consent of your legal representatives.
10. Community
You may use Community and sharing functions only lawfully, respectfully and for their intended purpose. Harassment, threats, fraud, impersonation, unlawful content and circumvention of protective mechanisms are prohibited. The Community Guidelines also apply.
11. Minors
NorthTrack Main as a whole is intended for persons aged 16 or older. All interpersonal Community, directory and sharing functions are currently designed as an 18+ area. Private non-social Main functions and required privacy/security actions remain available to users aged 16 or 17. NorthTrack uses a coarse age band shared after an explicit user action, either by self-declaration or through Apple's Declared Age Range; this is not official identity or age verification. Additional requirements for paid functions follow from section 9.
12. User content
You generally retain the rights to your own content. Where you deliberately share content, you grant NorthTrack the non-exclusive rights of use technically necessary to provide the selected sharing or Community function.
13. Intellectual property
NorthTrack software, trademarks, proprietary text, graphics and other protected content must not be reproduced or exploited without authority outside statutory permissions or express approvals. Third-party rights in data sources and open-source components remain unaffected.
14. Availability
Use of NorthTrack may depend on an internet connection, provider services, operating systems, cloud services and regionally available data sources. We cannot technically guarantee uninterrupted availability at all times.
15. Privacy
The processing of your personal data is described in the Privacy Policy. Data export, reset and account deletion are distinct from subscription cancellation and sign-out.
16. Suspension and termination
In the event of misuse or material breaches of these Terms or the Community Guidelines, we may restrict affected functions, suspend your account or terminate it for cause. Where the cause consists of a remediable breach of duty, termination for cause generally requires a prior warning or the unsuccessful grant of a reasonable period to remedy the breach, unless special circumstances justify immediate action after weighing both parties' interests.
17. Liability
(1) We have unlimited liability for damage arising from injury to life, body or health and in cases of intent and gross negligence.
(2) In cases of slight negligence, we are liable only for breach of material contractual obligations (cardinal obligations) whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely. In this case liability is limited to the foreseeable damage typical for the contract at the time it was concluded.
(3) We provide weather, map, airspace and other third-party data on a best-efforts basis. It may be time-critical, cached or incomplete and is not a sole basis for operational decision-making; official sources and the relevant POH/AFM remain authoritative.
(4) Your statutory rights for defects under sections 327i et seq. of the German Civil Code and our update obligation under section 327f of the German Civil Code remain unaffected by the above provisions.
(5) The above limitations of liability do not apply to claims under the German Product Liability Act.
18. Changes
We notify you of material changes to these Terms in an appropriate form; they take effect while preserving your statutory rights.
